Agreement to Terms
By accessing our website or using our services, you agree to be bound by these Terms of Service. Our services are available to residents of Greater Montreal who are at least 18 years old or who are acting on behalf of a person requiring care.
Our Services
Signature Care provides non-medical home care services including companion care, personal care, dementia care, respite care, live-in care, and hourly care. Our services are provided by trained caregivers. We do not provide medical, nursing, or clinical services. For medical needs, please consult with healthcare professionals.
Website and AI Chat
Our website provides information about our services and includes the Concierge, an AI-powered chat assistant. The Concierge can answer general questions and help collect your contact information, but does not provide medical advice or make care decisions. Information provided through the Concierge is not a substitute for professional assessment.
User Responsibilities
When using our services, you agree to: (1) Provide accurate and complete information; (2) Communicate openly about care needs and any changes; (3) Treat our caregivers with respect and provide a safe working environment; (4) Pay for services according to agreed terms; (5) Notify us promptly of any concerns or incidents; (6) Comply with the care plan developed for your loved one.
Payment Terms
Service rates are provided in your care agreement prior to services beginning. Payment is due according to the schedule outlined in your agreement (typically bi-weekly). We accept major credit cards, Interac e-Transfer, and pre-authorized debit. Late payments may result in service suspension. Cancellations with less than 24 hours notice may be subject to fees as outlined in your care agreement.
Limitation of Liability
Signature Care provides non-medical care services only. We are not responsible for medical decisions, diagnoses, or health outcomes. Our liability for any claims arising from our services is limited to the fees paid for the specific services giving rise to the claim. We maintain comprehensive general liability insurance coverage. Nothing in these terms limits liability that cannot be excluded by law.
Termination & Cancellation
Either party may terminate the care agreement with 7 days written notice. We require 24 hours notice for cancellation of individual scheduled visits. We offer a 30-day satisfaction guarantee: if you are not satisfied with your assigned caregiver within the first 30 days, we will provide a replacement and credit one shift at no charge. We reserve the right to terminate services immediately if there is a safety concern for our caregivers.
Intellectual Property
The Signature Care name, logo, website content, and materials are protected by copyright and trademark laws. You may not reproduce, distribute, or use our materials without written permission, except for personal, non-commercial use of website information.
Dispute Resolution
We encourage you to contact us first with any concerns so we can resolve issues directly. If a dispute cannot be resolved informally, it shall be submitted to mediation before any legal proceedings. The costs of mediation shall be shared equally.
Governing Law
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any legal proceedings shall be brought in the courts of the judicial district of Montreal, Quebec. The parties agree that the Quebec Consumer Protection Act applies to consumers.
Changes to Terms
We may update these Terms of Service from time to time. We will notify existing clients of material changes by email. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
